   Welcome to Aluma! These Terms and Conditions ("Terms") govern your use of the Aluma mobile application ("App") provided by Arcana Apps, LLC ("we," "us," "our"). By accessing or using Aluma, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the App.
2. Acceptance of Terms
   By downloading, accessing, or using Aluma, you confirm that you have read, understood, and agree to be bound by these Terms. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.
3. Age Restriction
   Aluma is intended for users who are at least 18 years old. By using the App, you represent and warrant that you meet this age requirement.
4. Privacy Policy
   Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using Aluma, you agree to the collection and use of your information as outlined in the Privacy Policy.
5. User Account and Registration
   If the App requires you to create an account, you agree to provide accurate, current, and complete information and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6. Use of Aluma
   Aluma provides users with conversational tarot card readings facilitated by an AI. The AI offers insights and advice based on the tarot cards drawn. Please note:
   • The guidance provided by Aluma is for entertainment purposes only and should not be interpreted as professional advice (e.g., legal, medical, psychological, or financial).
   • You are responsible for your own actions and decisions. We disclaim any liability for outcomes resulting from the use of the App.
   • The AI's insights may not accurately reflect your situation and are based on algorithmic interpretations.
7. Auto-Renewing Subscriptions
   Certain features of Aluma are offered on a subscription basis. By signing up for a subscription, you agree that your subscription may be automatically renewed, and you authorize us or the App Store to charge you for the renewal term. You must cancel your subscription according to the App Store's cancellation procedures. Deleting the App does not cancel your subscription.
8. Modification of Service
   We reserve the right to modify or discontinue any aspect of Aluma at any time, with or without notice. We are not liable for any modifications, suspension, or discontinuation of the App.
9. Intellectual Property Rights
   All content within the Aluma App, including but not limited to the virtual tarot deck, AI interactions, logos, text, graphics, and software, is the property of Arcana Apps, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our express written permission.
10. User Conduct
    You agree to use Aluma only for lawful purposes and in a way that does not infringe the rights of others. You are prohibited from:
    • Using the App for illegal activities or to harass, abuse, or harm others.
    • Attempting to reverse-engineer, disassemble, or hack the App or the AI.
    • Misusing the App's features in any way that could harm the App or other users.
    • Systematically retrieving data or other content from the App to create a collection, compilation, database, or directory.
    • Using any robot, spider, or other automatic device, process, or means to access the App.
11. Termination of Use
    We reserve the right to terminate or suspend your access to Aluma at our sole discretion, without notice, if you violate these Terms or engage in harmful behavior. Upon termination, your right to use the App will immediately cease.
12. Disclaimers
    Aluma is provided "as is" and "as available," without any warranties of any kind, either express or implied. We do not guarantee that the AI's insights will be accurate, reliable, or suitable for your situation. Use of the App is at your own risk.
13. Limitation of Liability
    To the fullest extent permitted by law, Arcana Apps, LLC and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Aluma, even if we have been advised of the possibility of such damages.
14. Indemnification
    You agree to indemnify, defend, and hold harmless Arcana Apps, LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses arising out of your use of Aluma or your violation of these Terms.
15. Governing Law and Jurisdiction
    These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding related to Aluma shall be brought exclusively in the courts located in the State of Delaware.
16. Arbitration and Class Action Waiver
    Any disputes arising from these Terms or your use of Aluma shall be resolved through binding arbitration conducted by the American Arbitration Association (AAA) in accordance with its rules. You agree to waive your right to a jury trial or to participate in a class action. The arbitration will take place in the State of Delaware and will be confidential.
17. Third-Party Links and Content
    Aluma may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or opinions expressed in such websites or resources. The inclusion of any link does not imply our endorsement of the website or resource.
18. In-App Purchases and Payment Terms
    If Aluma offers in-app purchases, all transactions are processed through the App Store or Google Play Store. Please refer to the respective store's terms for details on payments, refunds, and billing disputes. We do not handle or store payment information directly.
19. Severability
    If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
20. Entire Agreement
    These Terms constitute the entire agreement between you and Arcana Apps, LLC regarding your use of Aluma and supersede any prior agreements or understandings, whether written or oral.
21. Waiver
    Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

    We will send all notices and other communications regarding the Services to you using the contact information you provided during your Account registration or by posting the notice on the Services.
